Acceptance of Terms

By creating an account, accessing, or using Scuba Network, you agree to be bound by these Terms, our Privacy Policy, and all applicable laws and regulations. You confirm that you are at least 16 years old and that you have the legal capacity to enter into this agreement.

Service Description

Scuba Network is a platform for the diving community that enables users to log dives, discover dive sites, share experiences, create and join dive trips, track debris reports, connect with other divers, and access dive-related content. We may modify, suspend, or discontinue any aspect of the service at any time without notice.

Dive Information and Safety

Information Accuracy

Dive site information, conditions, and user-generated content (including dive logs, photos, and reports) are provided for informational purposes only. While we strive to facilitate accurate information sharing, we cannot guarantee the completeness, accuracy, timeliness, or reliability of any information on the platform.

Your Safety Responsibility

WARNING: Scuba diving involves inherent risks, including the risk of serious injury or death. You are solely responsible for your safety and diving decisions. Always dive within your training and certification limits, verify current conditions independently, use appropriate equipment, dive with a buddy, and follow established safety protocols. You must ensure you are medically fit to dive and should consult a physician if you have any doubts or medical conditions. Scuba Network is not a substitute for proper dive training, dive planning, professional medical advice, or on-site assessment of conditions. We are a platform, not a dive operator, and do not provide dive instruction or medical guidance.

No Liability for Diving Activities

We are not responsible for any injuries, accidents, deaths, property damage, or any other harm that may occur during diving activities. You use dive site information, user reports, and all platform content at your own risk. We strongly recommend verifying all information with local dive professionals before diving.

Disclaimers and Limitation of Liability

Important Notice

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited under English law.

"As Is" Service

Subject to the above, the platform is provided "as is" and "as available". To the extent permitted by law, we make no warranties or representations about the accuracy, reliability, completeness, or timeliness of the content, services, software, or information provided through the platform.

Limitation of Liability

Subject to the exclusions above, and to the maximum extent permitted by English law, Scuba Network Ltd and its officers, directors, employees, and agents shall not be liable for any indirect, consequential, or incidental losses or damages arising from your use of the platform, including but not limited to loss of profits, loss of data, loss of opportunity, or service interruptions.

Maximum Liability

Subject to the exclusions above, our total aggregate liability to you for any and all claims arising out of or related to these Terms or your use of the platform, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, shall not exceed £100 (one hundred pounds sterling). This cap does not apply to liability that cannot be limited under English law.

Diving Activity Disclaimer

We provide an information platform only. We are not responsible for the accuracy of dive site information, user reports, or diving conditions. We are not liable for any injuries, accidents, or deaths that occur during diving activities. You assume all risks associated with diving and must verify all information independently with qualified diving professionals.

User Content Disclaimer

We do not verify, endorse, or guarantee the accuracy of user-generated content, including photos, dive logs, reviews, or reports. Users are solely responsible for the content they upload. We are not liable for any reliance you place on user-generated content.

Account Responsibilities

Account Information

You are responsible for maintaining accurate account information and keeping your password secure. You must not share your account credentials or allow others to access your account.

Eligibility

You must provide accurate information during registration. You may not create an account if you have been previously banned from the platform.

Account Security

You are responsible for all activity under your account. Notify us immediately at info@scuba.network of any unauthorised access or security breach.

User Content and Conduct

Your Content

You retain ownership of content you post, including dive logs, photos, trip information, and comments. By posting content, you grant Scuba Network a non-exclusive, worldwide, royalty-free license to use, display, and distribute your content as necessary to provide and promote the service.

Content Responsibility

You are solely responsible for the content you post. You represent that you have the necessary rights to share your content and that it does not violate any laws or third-party rights. You are responsible for ensuring that any photos you upload are appropriate and do not contain illegal, obscene, or offensive material.

Prohibited Content

You may not post content that is illegal, threatening, harassing, defamatory, obscene, pornographic, fraudulent, invasive of privacy, infringing of intellectual property, or otherwise objectionable. This includes but is not limited to inappropriate photos, hate speech, or content that promotes violence. You may not impersonate others or misrepresent your affiliation.

Content Moderation

We reserve the right to remove content that violates these Terms or is otherwise inappropriate, without prior notice. We are not responsible for user-generated content and do not actively monitor all content. However, we will investigate reports of inappropriate content and take action as necessary.

Prohibited Uses

You agree not to:

  • Violate any local, national, or international laws or regulations
  • Harm, threaten, harass, stalk, or impersonate others
  • Send spam, unsolicited messages, or engage in unauthorised commercial activities
  • Scrape, crawl, harvest, or extract data from the platform using automated means without permission
  • Interfere with, disrupt, or compromise the platform's operation, security, or infrastructure
  • Exploit vulnerabilities, bypass security measures, or access restricted areas
  • Post false, misleading, or inaccurate information, especially regarding dive sites, conditions, or safety
  • Create multiple accounts to evade bans, manipulate content, or deceive other users
  • Upload inappropriate, illegal, obscene, or offensive photos or content

Referral Programme and Competitions

Scuba Network operates a referral programme that rewards users for logging dives and inviting other divers to join the platform. We may run competitions, leaderboards, and prize draws based on the points earned through this programme. Your participation in the referral programme and any competitions is voluntary and subject to the terms set out below.

Verification of Identity

Before we issue any prize, reward, or public recognition to you in connection with the referral programme or any competition, we may ask you to verify your identity. This may include a request for an interview, submission of official identification, or other reasonable proof that you are a real person and not a fabricated account. We do this to protect the integrity of the programme and ensure that prizes go to genuine users. If we cannot verify your identity to our satisfaction, we may withhold any prize or reward.

Prohibited Conduct and Sanctions

You must not operate multiple accounts solely to generate referral points, fabricate or falsify dive log entries, manipulate the referral chain, or otherwise attempt to gain an unfair advantage in the points system. Users found to be in breach of this rule will forfeit all points associated with the breach and any related accounts. In serious or repeated cases, we may permanently ban you from the platform. We may take these steps without warning.

Right to Exclude

If we have reasonable grounds to suspect that you have breached these terms, engaged in fraud, or acted in a manner that undermines the integrity of the referral programme or any competition, we may exclude you from receiving any prize, reward, or public recognition. We may do this at our sole discretion and without prior notice. We are not obliged to disclose our reasons or to share evidence with you before taking this action.

Public Profile Requirement for Prize Claims

To be eligible to publicly claim or receive any prize or publicly-announced reward in connection with the referral programme or competitions, your profile must be set to public at the time the prize is awarded. Users who choose to keep their profiles private may continue to earn and accumulate points, but cannot be named on any public leaderboard, award list, or prize announcement. If you wish to claim a prize, you must make your profile public before we announce the award.

Termination

By You

You may request account termination at any time by contacting us at info@scuba.network.

By Us

We may suspend or terminate your account immediately if you violate these Terms, upload inappropriate content, engage in fraudulent activity, harass other users, or for any other reason at our sole discretion. We may terminate accounts without prior notice.

Effect of Termination

Upon termination, your right to use the platform ceases immediately, and you will lose access to your account. We may retain certain information as required by law or for legitimate business purposes. Public content you created (such as dive logs) may remain visible if already shared with other users.

Intellectual Property

Platform Rights

The Scuba Network platform, including its design, code, features, logos, and trademarks, is owned by us and protected by intellectual property laws. You may not copy, modify, distribute, sell, or reverse engineer any part of our platform without written permission.

Third-Party Content

Respect the intellectual property rights of others. Do not upload photos or content you do not own or have permission to share. If you believe content on our platform infringes your copyright, please contact us at info@scuba.network with details including the URL of the infringing content and proof of ownership.

Third-Party Services

Our platform integrates with third-party services including Google Maps for mapping, Supabase for infrastructure, and others. Your use of these services is subject to their respective terms and privacy policies. We are not responsible for the availability, functionality, or content of third-party services.

Indemnification

You agree to indemnify, defend, and hold harmless Scuba Network, its affiliates, and their respective officers, directors, employees, and agents from and against any claims, demands, losses, liabilities, damages, costs, and expenses (including reasonable legal fees) arising from: (a) your use of the platform; (b) your content; (c) your violation of these Terms; (d) your violation of any rights of another party; or (e) any diving activities undertaken based on information obtained from the platform.

Governing Law and Disputes

Governing Law

These Terms and any dispute or claim arising out of or in connection with them or their subject matter shall be governed by and construed in accordance with the law of England and Wales.

Jurisdiction

The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim that arises out of or in connection with these Terms or their subject matter.

Informal Resolution

Before starting any legal proceedings, we encourage you to contact us at info@scuba.network to attempt to resolve the matter informally. We will work in good faith to resolve disputes amicably.

Changes to Terms

We may update these Terms periodically. We will notify you of material changes by posting the updated Terms on this page and updating the "Last Updated" date. Your continued use after changes constitutes acceptance of the updated Terms. If you do not agree to the changes, you must stop using the platform and contact us to terminate your account.

General Provisions

Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions will remain in full force and effect.

Waiver

Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision. Any waiver must be in writing and signed by us.

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Scuba Network regarding the use of our platform and supersede all prior agreements.

Assignment

You may not assign or transfer these Terms or your account without our prior written consent. We may assign these Terms without restriction, including to affiliates or in connection with a merger or sale of assets.

Translations

We strive to make our entire platform, including these Terms and Conditions, all legal documents, user interface, content, and features, available in multiple languages to serve our global diving community. All translations have been created using artificial intelligence (AI) technology. While we make reasonable efforts to ensure accuracy, we cannot guarantee that translations are completely error-free, fully capture all legal nuances, or perfectly convey the intended meaning in all contexts. The English version of these Terms and Conditions and all other documents is the authoritative version and will prevail in the event of any inconsistency, ambiguity, or dispute regarding interpretation.
